Default custom forms not displaying for recipient

I tried that and they still only receive the companies disclaimer, could the
need published on the server and not locally in personal forms?

Send form def, ticked and read page setup, feilds linked etc.

checked that form is in rtf format

Recipient has published form locally on his machine from the .fdm.
